Personal Property Foreclosure

The purpose for filing a Personal Property Foreclosure is to regain possession of property, as a result of a violation of either: a contract retaining title or a security agreement. Either agreement must be in writing, signed by debtor, with a description of secured property. 

When filing a Personal Property Foreclosure you must determine where to file your action. Venue can be the county in which the defendant resides or the county in which the property is located. At the time of filing a foreclosure the plaintiff must submit a copy of the contract or security agreement.

A Designation of Agent for Business Entity is required if you are filing on behalf of a business or another person.

An Affidavit of Military Service must also be filed.
