Decedent's Estates Court Fees

All initial filing fees must be paid upon filing the petition with the Probate Court. The Probate Court will accept debit/credit cards (a service fee will be assessed on all credit card transactions), cash, money orders, or personal checks made payable to "Worth County Probate Court.” Personal checks are not accepted for weapons carry license.

Filing Fees in an Initial Proceeding as defined by O.C.G.A. § 15-9-60(e)(2)

Please note a recording fee in the amount of $2.00/page is required for essentially every document filed in the Probate Court. There may also be other fees such as certified letters, certified mail/postage, sheriff service, and other miscellaneous fees acquired that must be paid in full before a final order and/or letters are issued.  These fees are in addition to the initial filing fees set forth below:

  • Petition for Letters of Administration:    $157.50
  • Petition to Probate Will in Solemn Form: $157.50
  • Petition to Probate Will in Solemn Form and for Letters of Administration with Will Annexed: $157.50
  • Petition for Year's Support: $157.50
  • Petition for Temporary Letters of Administration: $157.50
  • Petition for Discharge of Personal Representative: $62.50
  • Petition to Enter Safe-Deposit Box: $37.50

Miscellaneous Fees

  • Amendments: $15.00
  • Recording: $2.00 per page
  • Objection/Caveat: $62.50 (Estate) or $82.50 (Guardianship)
  • Certified Mail: $3.50 (out of state service) or $8.80 (in state restricted delivery) + $2.80 (return receipt) & standard postage
  • Personal Service in Worth County: $50.00 
  • Personal Service outside of Worth County: $50.00 (unless fees are stated differently in the county of service)
  • Certified Copies: $10.00 each

  1. Fees for publication of notice are NOT included in court fees. 
    Payment should go to The Sylvester Local at the time of presenting Notice for publication. 
     
  2. Fees for Guardians-Ad-Litem, Court-Appointed Attorneys, and Court-Appointed Evaluators, when collected by the court, are in addition to the above court costs unless noted herein.
